Terms of Use

1. Terminology and Acceptance of Terms

 

The following terminology applies throughout these Terms and Conditions:

⬡ “Client," “You," and “Your" refers to you, the person or entity accessing and using Axxonlab’s services
⬡ “The Company," “Ourselves," “We," “Our," and “Us" refers to Axxonlab
⬡ “Party," “Parties," or “Us" refers to both the Client and ourselves
⬡ “Services" refers to Axxonlab’s website, services, or facilities

By accessing and using Axxonlab’s Services, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Services.

 

2. Services Description

 

Axxonlab provides environmental testing, laboratory analyses, and consulting services, including on-site assessments of indoor environments. These services may be performed at residential, commercial, or industrial properties at the request of property owners, landlords, business owners, or tenants. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice.

 

3. On-Site Assessment and Tenant Services

 

3.1 Service Requests from Tenants

Axxonlab provides services upon request from various parties, including tenants of residential or commercial properties
While we recommend tenants obtain landlord approval before scheduling services, Axxonlab is not responsible for verifying the relationship between tenants and property owners nor any required approvals between tenants and landlords
Tenants requesting our services represent that they have the authority to grant access to the property

3.2 Liability Disclaimer for Tenant-Related Services

Axxonlab is not liable or responsible for any breaches of contract or lease agreements that may exist between the tenant and landlord
When Axxonlab is requested or hired to perform testing, consulting, or other related non-destructive services on a rented property, we are not liable for any claims of trespassing or related offenses
Our presence and services are performed based on the invitation and representation of the requesting party who claims to be a tenant or responsible party for the property
Any disputes arising from unauthorized access or lease agreement violations remain solely between the tenant and property owner

3.3 Property Access and Safety

We require safe and reasonable access to perform requested services
The requesting party is responsible for ensuring our access is authorized
Axxonlab reserves the right to refuse service if we have reason to believe access is unauthorized or unsafe

 

4. Sampling and Assessment Risks

 

4.1 Property Damage During Assessments

Axxonlab is not liable or responsible for repairing any damages incurred during invasive or bulk sampling assessments
This includes, but is not limited to:

⬡ Unintentional damages to ceiling structures during attic inspections

⬡ Paint damage resulting from adhesive application

⬡ Minor damages from bulk sample collection

⬡ Any incidental damage occurring during normal assessment activities

⬡ While all reasonable precautions will be taken to protect the environment during visits, some damage may be unavoidable during necessary testing procedures

4.2 Asbestos Sampling and Related Risks

All asbestos sampling will be conducted safely and in accordance with industry best practices
Exposure to asbestos fibers during the sampling process is a possibilityAxxonlab is not responsible for:

⬡ Providing personal protective equipment (PPE) to building occupants

⬡ Any real or perceived health risks resulting from the sampling process

⬡ Long-term exposure risks outside the sampling period

While sampling processes are conducted in a controlled fashion with risk mitigation measures, Axxonlab bears no liability for any potential exposure during the collection and/or disturbance of potential asbestos-containing materials or other contaminants

 

5. Data Collection and Usage

 

5.1 Sample Collection and Ownership

All samples collected and analyzed at our laboratory become the property of Axxonlab upon completion
Samples may be further utilized for internal training, quality control, or other related projects on an as-needed basis

5.2 Photography and Media

Photos or videos taken during assessments may be used for internal training, marketing, or social media purposes
All personal information, including faces, photographs, house numbers, or other personally identifiable items will be removed, obscured, or unfocused before any such use

5.3 Call Recording

All calls are recorded for quality assurance and training purposes
Recordings may be deleted after 30 days or retained for up to 182 days
Regular deletion of calls, intentional or automated, may occur as part of security, maintenance, and system upgrades

5.4 Website Form Submissions

Form submissions through our website or landing pages will be retained until they are no longer required for business purposes.

5.5 Laboratory Data Usage

Analysis results may be utilized for internal training programs or development initiatives
Data may be incorporated into datasets for AI-based models for future use
All personal information will be kept private and confidential

 

6. Payment Terms

 

6.1 Accepted Payment Methods

We accept the following payment methods:

⬡ All major credit/debit cards

⬡ Bank transfers and Interac e-transfers

⬡ Personal cheques, cash, and company cheques

⬡ Digital payment platforms (specified on our payment portal)

6.2 Payment Timeline

Payment is due within 30 days of invoice date
Late payments may incur additional fees
We reserve the right to suspend services for accounts with outstanding balances
Delinquent invoices may be subject to escalation to a Collections Agency if no communication or plans to resolve such an invoice occurs

6.3 Returned Payments

Returned checks may incur a $50 administrative fee
Multiple returned payments may result in requirement for alternative payment methods
All associated collection costs will be the responsibility of the client

6.4 Refunds

All refund requests must be submitted by email: support@axxonlab.com
All refund requests will undergo a comprehensive review, which may include interviews with personnel or clients involved, and reviews of phone calls, emails, texts, service agreements, and all other forms of communication
Axxonlab reserves the right to refuse a refund request on a case by case basis and reserves the right to issue credits or alternative compensation
Refund requests will be handled promptly, with decisions or actions rendered within 7 business days
Refunds will only be provided via the original payment method

 

7. Cancellation Policy

 

Minimum 24-hour notice required for cancellation of scheduled services
Cancellations with less than 24-hour notice may incur a fee of $95
No-shows may be charged the full service fee
Emergency cancellations due to circumstances beyond client control will be evaluated on a case-by-case basis

 

8. Privacy and Data Protection

 

8.1 Data Handling

Axxonlab collects data online, over the phone, and in-person in good faith
We implement reasonable security measures to protect your information
Any breach of data that may occur is not intentional

8.2 Information Sharing

Axxonlab does not share, sell, or lend any client information to any party for marketing, re-selling, or sales targeting purposes.

 

 

9. Copyright and Intellectual Property

 

9.1 Ownership

All content, graphics, videos and designs on Axxonlab websites and materials are protected under applicable copyrights and trademarks
The Axxonlab name, logo, and brand elements are registered trademarks
All reports, documentation, and analysis results remain the intellectual property of Axxonlab

9.2 Usage Restrictions

You may not:

⬡ Copy, republish, or distribute our content, including internal documents, such as reports, laboratory certificates, or others, without written permission
⬡ Use our trademarks or brand elements without authorization
⬡ Modify or create derivative works from our materials
⬡ Sell or commercialize any of our intellectual property

 

10. Force Majeure

 

Neither party shall be liable for any failure to perform due to circumstances beyond reasonable control, including but not limited to:

⬡ Natural disasters
⬡ Acts of war or terrorism
⬡ Government actions or regulations
⬡ Pandemics or public health emergencies
⬡ Civil unrest or labor disputes
⬡ Technology failures beyond our control

 

11. Dispute Resolution

 

11.1 Initial Resolution

Parties agree to attempt good-faith negotiation of any disputes
Unresolved disputes will proceed to mediation
Mediation costs will be shared equally unless otherwise agreed

11.2 Legal Proceedings

If mediation fails, disputes will be resolved in courts of the applicable jurisdiction, with costs awarded as determined by the court.

 

 

12. Security Policy

 

12.1 Information Security

We maintain comprehensive security protocols for all data
Access to sensitive information is strictly controlled
Regular security audits and updates are performed
Employee training on security procedures is mandatory

12.2 Incident Response

Security incidents are addressed promptly
Affected parties will be notified as required by law
Post-incident analysis and improvements are standard procedure

 

13. Third-Party Links and Services

 

Links to third-party websites are provided for convenience only
We are not responsible for third-party content or practices
Use of third-party services is at your own risk
We recommend reviewing third-party privacy policies

14. Virtual Services

 

14.1 Remote Assessments

Virtual assessments or consultations are subject to technical limitations
Quality of virtual services may depend on client’s technology
Recommendations from virtual assessments may require in-person confirmation

14.2 Digital Content

Screenshots, recordings, and digital materials from virtual services may be used for training, reports or marketing materials
Client confidentiality is maintained in all digital content usage

 

15. Changes to Terms

 

 

Axxonlab reserves the right to modify these Terms of Use at any time. We will notify users of any material changes by posting the updated terms on our website. Your continued use of the Services after such modifications constitutes your acceptance of the updated terms.

 

 

16. Governing Law

 

 

These Terms of Use shall be governed by and construed in accordance with the applicable local laws, without regard to its conflict of law provisions.
